Oudism – Website Terms of Use
Effective date: 1 January 2025
These Terms of Use (Terms) govern your access to and use of the website located at oudism.com and all related subdomains (Site), and your purchase of products and services offered by 611 Holdings Pty Ltd trading as Oudism(Oudism, we, us, our).

If you are a consumer in Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms limits those rights.
2. Acceptance of these Terms
By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and any policies referenced in them (including our Privacy Policy and any program‑specific terms). If you do not agree, you must not use the Site.
We may update these Terms from time to time. Changes take effect when posted on the Site with the updated effective date. For material changes, we will use reasonable efforts to notify you (e.g., banner notice or email if you have an account).
3. Eligibility and accounts
You must be at least 18 years old, or the age of legal majority in your location, to create an account or place an order. You are responsible for maintaining the confidentiality of your login details and for all activity under your account.
We may suspend or terminate accounts at any time where we reasonably suspect breach, abuse, fraud, chargeback risk, or security issues.
4. Honor Circle loyalty program (summary)
We may offer a loyalty and membership program called Honor Circle (the Program, also spelled "Honour Circle" in some materials). Participation is at our discretion and we may approve, decline, suspend or terminate membership at any time.
- Benefits & tiers: We may offer benefits, tiers and eligibility criteria. We may change, pause or end the Program or any benefits at any time.
- No cash value: Points, credits, status and benefits have no cash value, are non‑transferable and may expire.
- Stacking: Combining discounts, codes or benefits is prohibited unless expressly permitted.
- Abuse: We may adjust, cancel or claw back benefits for suspected abuse, error or breach.
- Program Terms: Additional or replacement terms may apply and will prevail where inconsistent with these Terms.
(If we publish separate Honor Circle Terms, those will apply and replace this summary.)
5. Orders, pricing and availability
Prices are typically displayed in USD (or AUD if selected). Displayed prices exclude shipping and any import duties, taxes or charges unless stated otherwise.
We may correct errors or cancel orders where there is a genuine pricing or availability mistake. If a product becomes unavailable after you order, we may cancel and refund you.
Pre‑orders & custom orders: We may offer pre‑orders and custom orders. Pre‑orders are charged at checkout. Dates are estimates only. Custom orders may have longer lead times. To the extent permitted by law, pre‑orders and custom orders are not cancellable once placed (this does not affect your ACL rights).
Subscriptions: If offered, subscriptions will auto‑renew and your payment method will be charged each cycle until you cancel effective at the end of the current cycle.
6. Payment
We accept major payment methods made available at checkout (for example, Shopify Payments, Apple Pay, Google Pay, and card payments). Charges occur at checkout. You authorise us (and our payment processors) to process your payment. We do not store full card details.
7. Shipping, delivery & risk
Destinations: We ship to key countries including Australia, New Zealand, United States, Canada, United Kingdom, European Union member states, Switzerland, Singapore, Hong Kong SAR, Japan, South Korea, and countries in the Middle East including UAE, Saudi Arabia, Qatar, Kuwait and Bahrain. We do not ship to countries in Africa. We do not ship to destinations subject to comprehensive sanctions or severe logistics restrictions (including, without limitation, North Korea, Iran, Syria, Cuba, Russia, Belarus, and the Crimea/Donetsk/Luhansk regions). We may refuse orders to other locations where shipping is unsafe or commercially unreasonable.
Duties & taxes: International orders are usually shipped DAP/Delivered At Place. You are responsible for any import duties, VAT/GST and customs clearance fees charged by your country.
Risk & title: Title to products passes on full payment. Risk of loss passes on dispatch from our facility or our fulfilment partner. This clause does not limit your rights under the ACL and does not apply to loss or damage caused by our failure to comply with consumer guarantees.
Delivery timeframes: Any delivery dates are estimates. Actual timeframes depend on the destination, courier capacity and customs processing. We are not liable for delays outside our control, but we will take reasonable steps to help resolve courier issues.
Failed delivery/return to sender: If a parcel is returned due to incorrect address, uncollected customs fees, or the courier’s inability to deliver, we may (at your election): (a) reship once you pay the actual reship postage; or (b) issue store credit for the order value less original shipping and any carrier return fees. To the extent permitted by law, refunds for failed delivery are not available unless required by the ACL.
Loss/theft after delivery: Where tracking shows delivered, subsequent loss or theft is outside our control; please raise a police report and carrier claim. If you purchased our Priority Replace & Reship add‑on (see below), we may offer a faster resolution.
8. Optional “Priority Replace & Reship” service
We may offer an optional paid add‑on at checkout that provides priority support and expedited replacement or store credit for parcels lost or damaged in transit, or confirmed porch‑theft after carrier delivery. This add‑on is a customer service program and not an insurance product. It does not limit your ACL rights. Terms and coverage details will be shown at checkout and on your order confirmation.
9. Returns, refunds & Australian Consumer Law
Change of mind: To the extent permitted by law, we do not offer change‑of‑mind returns, including where a product has been opened or used.
Faulty or misdescribed items: If your product is faulty, unsafe or not as described, you are entitled to a remedy under the ACL. Depending on the issue, remedies may include repair, replacement or refund. Contact us at hello@oudism.comwith your order number, issue description and photos/video.
Return shipping: Where a return is required, you are responsible for return shipping unless the ACL requires us to cover it (e.g., for major failures or where the item is not of acceptable quality).
Digital items: Certificates of authenticity and other digital content are provided “as delivered.” Change‑of‑mind refunds are not available for digital items after delivery, except as required by the ACL.
Custom & pre‑order items: Except as required by law, custom or pre‑order items are not refundable once production/fulfilment has commenced.
10. Product care & safety (burners and agarwood use)
Agarwood burning produces smoke and heat. Always ensure adequate ventilation, use on heat‑resistant surfaces, keep away from flammable materials, and never leave burning materials unattended. Keep out of reach of children and pets. Follow local fire and building regulations applicable to your premises. Misuse may cause fire, burns or property damage. To the maximum extent permitted by law, we are not responsible for damage resulting from improper use or failure to follow safety guidance.
11. Intellectual property
The Site and its content (including text, photos, product images, videos, graphics, logos and trade marks) are owned by us or our licensors and are protected by intellectual property laws. All rights are reserved.
You are granted a limited, revocable, non‑exclusive licence to access and use the Site for personal, non‑commercial purposes. You must not copy, reproduce, publish, frame, scrape, data‑mine, train models on, or create derivative works from the Site or its content except as permitted by law or with our written consent.
Customer reposting: You may repost our content non‑commercially on personal social accounts provided you (a) do not modify it, (b) include clear attribution to @oudismofficial (or as we specify), and (c) include a link to oudism.com. Any other use (including commercial use, advertising, product resale pages or marketplace listings) requires our prior written permission. We may withdraw permission at any time.
Trade marks: Oudism and associated marks are our trade marks. Third‑party marks and content remain the property of their respective owners and are used with permission.
12. Your content (UGC)
If you post, upload or otherwise submit reviews, photos, videos, testimonials, or other content to or via the Site or our social channels (UGC), you:
- represent that you own or control the rights in the UGC and that it is lawful and not misleading;
- grant us a worldwide, perpetual, irrevocable, royalty‑free, transferable licence (with the right to sub‑licence) to use, host, store, reproduce, adapt, publish, translate, create derivative works from, communicate, publicly perform and display, commercialise and otherwise exploit the UGC in any media and for any purpose (including advertising and promotion);
- consent to acts or omissions in relation to the UGC that might otherwise infringe your moral rights (to the extent permitted by law); and
- agree that we may allow search engines and AI recommendation systems to access, index and surface your UGC in accordance with our technical settings and policies.
We may moderate, remove or refuse UGC at our discretion. You remain responsible for your UGC and indemnify us for losses arising from UGC that breaches these Terms or infringes third‑party rights.
13. Acceptable use
You must not misuse the Site, including by:
- violating laws, infringing IP or privacy rights, or posting unlawful, defamatory, obscene or deceptive content;
- attempting to interfere with or compromise the Site’s security or integrity;
- bulk‑downloading, scraping or automated harvesting, except via our publicly documented interfaces or with written permission;
- purchasing products for unauthorised resale or diversion; or
- circumventing technical measures or rate limits.
We may refuse, limit or cancel orders we reasonably suspect are for resale or grey‑market diversion. We may also report counterfeit or fraudulent activity to platforms and authorities.
14. Third‑party services & links
We use third‑party platforms and services to operate the Site and fulfil orders (for example, Shopify, Shopify Payments, Apple/Google Pay, Google and Meta analytics/ads, Loox reviews, Klaviyo, Bloggle and logistics partners). Those services have their own terms and privacy practices. We are not responsible for third‑party sites or services.
15. Provenance verification (“Tap to Verify”)
We may provide NFC or similar verification features to help you confirm product provenance. These tools are informational only and are not a warranty of performance or suitability. Cloned or tampered tags and hardware/software limitations may affect results. Always purchase from authorised channels. Report suspected counterfeits to hello@oudism.com.
16. Warranties and disclaimers
To the maximum extent permitted by law, the Site is provided “as is” and “as available”. We do not warrant uninterrupted or error‑free access, or that content is complete, accurate or current. However, nothing in these Terms excludes, restricts or modifies any right or remedy you have under the ACL.
17. Liability
To the maximum extent permitted by law, our aggregate liability to you for all claims arising out of or in connection with the Site, these Terms, or any products or services purchased via the Site is limited to the amount you paid us for the relevant products or services in the 12 months preceding the claim.
This limitation does not apply to liability that cannot lawfully be limited or excluded, including under the ACL, or to liability for death or personal injury caused by our negligence, fraud, or wilful misconduct.
18. Indemnity
You indemnify us (and our directors, officers, employees and partners) from and against all losses, liabilities, costs and expenses (including reasonable legal fees) arising from your: (a) breach of these Terms or applicable laws; (b) UGC; (c) misuse of the Site or products; or (d) infringement of any third‑party rights.
19. Suspension and termination
We may suspend or terminate your access to the Site or any account at any time for suspected breach, abuse, fraud, security risk, non‑payment or where required by law or a platform partner. On termination, licences granted by you survive to the extent necessary for us to exercise rights already granted.
20. Complaints and dispute resolution
If you have a concern, please contact hello@oudism.com. We aim to respond promptly. If we cannot resolve a dispute, you and we agree to negotiate in good faith and may use mediation through the Australian Disputes Centre (Sydney) before commencing court proceedings (this does not prevent urgent injunctive relief).
These Terms are governed by the laws of New South Wales, Australia. You submit to the non‑exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.
21. Privacy & cookies
Our collection and use of personal information (including via cookies, analytics and advertising pixels such as Google and Meta) is described in our Privacy Policy, which forms part of these Terms.
22. Miscellaneous
If any part of these Terms is invalid or unenforceable, the remainder remains in force. A waiver must be in writing. You must not assign your rights without our consent. These Terms constitute the entire agreement between you and us regarding the Site.
